Did we take every step the law requires before this fine, and is it within the limit?
A Colorado board fines $25 a day for a boat trailer in a driveway, ten days so far. The owner got a certified letter with 10 days to move it and was offered a hearing, and the fine policy is in writing.
2 of the 6 steps Colorado law requires are not done: daily fines are banned, and the owner needed 30 days to cure. The $250 charged is within Colorado’s $500 total for this violation.
Answer what was done before the fine: the written policy, how the owner was told, the days to fix it, the hearing. The page holds each answer against the steps your state’s law requires.
The rules for Arizona, California, Colorado, Florida and Texas come from The Rebel Standard’s page for each state, which quotes the statute section. Each step on this page names its section.
For any other state, the page checks what your governing documents ask for and says plainly that your state’s own law was not checked.
It depends on the state. Colorado bans daily fines and caps fines for a violation that does not threaten health or safety at $500 in total (C.R.S. § 38-33.3-209.5(1.7)(b)). Florida caps a continuing violation at $1,000 unless the documents say otherwise (Fla. Stat. § 720.305(2)).
In all five states this page checks, yes: the owner gets notice and a chance to be heard first (in Texas, a hearing the owner asks for within 30 days). Florida requires a committee of at least three members who are not officers, directors or employees to approve the fine.
$100 per violation, unless the board finds in writing, at an open meeting, that the violation may harm health or safety (Cal. Civ. Code § 5850).
Rebel HOA keeps every violation notice, appeal and fine on one record.
